We need the assistance of the marketing community to help our company
during a fight in a civil lawsuit in Maryland. Our company and we
individually, as corporate owners, have been named as defendants.
The emails that MBPAdvertising is being sued for by Beyond Systems,
Inc are safelist emails sent from the MBPSL safelist to a verified,
bonified, confirmed, double-optin member of the MBPSL safelist who
obviously requested and never complained about receiving the email.
Beyond Systems, Inc is the company that owns the domain where the
emails were sent.
The final ruling of this lawsuit in regards to commercial confirmed
email has the potential to affect marketing on the internet via email,
whether it is your own mailing lists, ezines, newsletters, safelists,
optin lists etc. All program owners that operate mailing lists could
be affected by this outcome! The internet community and we need your
help! With your help we can keep our company floating while we fight
this injustice and help the internet community!
Through our reputation on the internet over the last 8 years, we have
always tried to live by the "golden rule". We make it a policy to be
honest and treat others the way we would want to be treated. Vincent
and I have built our company's reputation on honesty, morality,
integrity, reliable and unique programs and exceptional customer
support. In this field of business the turnover for companies is very
short. In a lot, if not most cases, companies such as ours last only a
few months. I think one "secret" to our company's longevity is always
being reachable by our customers. We always make sure that our
customers have several ways to contact us. When new customers call
support they always seem to be expecting some "support technician" and
when they get Val personally, they're surprised.
I guess if one thing sums up what has made us last almost ten years is
"following the golden rule". We are not perfect at all, we just
try really hard to treat others the same as we would want to be treated.
We have hired a top notch lawyer to defend us, who is as determined as
we are, to let the truth be known. Our lawyer knows his stuff and is
worth every penny he earns. But in this day and age with civil
lawsuits it seems like you are guilty until you can prove your
innocence and proving innocence is not cheap! Due to this, the legal
cost is compounding daily. We are prepared to do whatever we can to
see it through to the end. Not only does our livelihood depend on it
but the legitimacy of this profession is under attack. We have been
unjustly accused PERIOD!

We know in our heart and gut that in
the end the truth will prevail. But until that point, my partner,
Vincent Bryant and I are trying to come up with ways to earn the extra
cash to help float our company through this lawsuit and also to help
cover some of the cost of the litigation so we do not lose everything
we have worked so hard for. The cost of the lawyer is high and we are
finding ourselves scrambling to make the expenses due to this large
cost especially during the slow period that the last few months have
been. We are spending all of our time in researching and defending
ourselves in this litigation, instead of doing the things that bring
in the cash flow like we would ordinarily do.
We truly do appreciate your help with
